Minimul level of injury
For someone to claim criminal injury compensation, there is a minimum level of injury required for the claim to be viable. It would defeat the whole process and be totally unmanageable for the CICA if criminal injury compensation was allowed for minor injuries such as a bruise or a scratch.
The criminal injuries compensation scheme provides that an applicant (the person making the claim for criminal injury compensation) must have suffered a physical or mental injury, or both, that is serious enough to be included in one of the tariff bands of the scheme.
The lowest level of compensation that can be awarded by the CICA is a level 1, which equates to £1,000. There are circumstance where an applicant may be eligible for criminal injury compensation if they have a number of minor injuries. In this case, the applicant will have to demonstrate that there are at least three minor injuries, which persisted for a minimum of six weeks and necessitated two visits to a doctor during this time.
