Criminal Injury Claims

Loss of Earnings

How loss of earnings are calculated by the CICA

The CICA will only compensate you for loss of earnings, if you have lost the ability to work because of your injury, for at least 28 WEEKS.
You may be able to claim loss of earnings from WEEK 29, when you make a criminal injury compensation claim. You may be also eligible to receive special expenses if you were incapacitated for at least 28 WEEKS.

Special expenses include the cost of private health treatment ( that is reasonable ), special adaptations to your home and special equipment.

Our friendly team can help you gain criminal injury compensation......Ask for Nicola, Ruby or John......We are open seven days a week.........

The CICA will deduct from your loss of earnings compensation ANY benefit you have recieved from state benefits, insurance payouts and compensation awarded by criminal or civil courts. Simply, you cannot benefit twice.
Your standard tariff award is NOT AFFECTED by this. So, if you only receive a standard award and NO loss of earnings award, then you will suffer NO DEDUCTION by the CICA.

If you the person who injured you, was brought to trial and the told to pay you compensation, this amount of compensation will automatically be deducted from your final award. Even if the convicted person has never paid you a single penny, you will still have this amount deducted. It seems very unfair, but that's the way it is. By the way, this is very common indeed.
