Can I still make a CICA Criminal Injuries Compensation claim?

There is nothing to prevent you making a CICA Criminal Injuries Compensation application even if you have an existing criminal record.

As a matter of course, the CICA will make a criminal conviction check to find out if you have any unspent criminal convictions. The CICA will therefore find out if you have any unspent convictions. There is absolutely no point in failing to disclose this on the application form in the hope that the CICA will not check, they will.

The Scheme provides for a penalty point reduction which translates into a percentage reducion of your compensation. In its simplest terms, the more recent a convcition and the more serious the penalty, the more penalty points your conviction will attract. The CICA will also take into account conviction that happen during the investigation of your compensation claim and also up until your claim is settled.

So, if you have say an outstanding court appearance, then the CICA will wait until the outcome of the case before deciding your CICA claim. This system is , of course, quite fair. Only applicants who are without a criminal history should benefit in full, while those who have  unspent criminal convictions will suffer a reduction in compensation or in the worst case, no compensation at all.

The Penalty point system works like this:

1    point = 10% reduction

2  points = 15% reduction

3  points = 25% reduction

4  points = 30% reduction

5  points = 35% reduction

6  points = 50% reduction

7  points = 60% reduction

8  points = 70% reduction

9  points = 80% reduction

10 points = 100% reduction
