The CICA use a penalty point system to reduce criminal injury compensation awards to applicants who have a criminal record. The CICA has to follow the Scheme and will automatically check to see is you have any criminal convictions. Not only will the CICA check for convictions you already have, they will check for any convictions you have receive after you made your application for criminal injuries compensation.
The Scheme says this We will also take account of any convictions you receive after the incident or after applying, ricght through to the date when your case is finally settled.
Although, the CICA is not bound by the penalty points system, it is the starting point. They consider all convictions. penalty points and all other circumsatnces of the application for compensation.
The deductions are formulated this this:
1 penalty point = 10% reduction
2 penalty points = 15% reduction
3 = 25%
4 = 30%
5 = 35%
6 = 50%
7 = 60%
8 = 70%
9 = 80%
10 = 100%
If you acrue 10 penalty points or more, then you will receive nothing.
