Criminal Injury Compensation for criminal assaults. The facts.
The CICA has to follow certain guidelines when the applicant has been assaulted by a family member or partner. These are hard and fast rules.
The CICA will not make an award of criminal injury compensation if the applicant is still living with the assailant. It would be wrong that the attacker should benefit from the compensation the applicant would receive. Living in the same household also makes it feasible that the attacker could benefit from the applicant's compensation. The applicant would have to demonstrate that they no longer live with the assailant and they have no intention to live togther again. Indeed, the rule states at paragraph 17(b)
in the case of violence between adults in the family, a claim officer is satisfied that the applicant and the assailant stopped living together in the same household before the application was made and are unlikely to share the same household again.
These rules also apply to a man and woman living together as husband and wife, and same sex partners living together whether or not they are civil partners.
The CICA may also contact any HM Prison if the attacker has been imprisoned to check whether the applicant has visited their attacker. This may indicate that the attacker may again reside with the applicant after release or may receive gifts from the applicant, or that their attacker may exert some control over the victim by manipulation or fear.
Further, the CICA will expect the applicant to fearlessly assist the police and Crown Prosecution Service in bringing a prosecution against their attacker. If the applicant has not done this, then the CICA will most certainly not make any award of compensation.
