Behaviour before, during or after the assault
The CICA will look at all the information surrounding the event. If you behaviour started the assault, or contributed to the event, then it is unlikely that you will receive any compensation.
So, asking someone for a fight, where you get injured is clearly not going to be compensated. Trying to defend someone who is being attacked is a different matter. It is likely that you will receive compensation if the risk to took was both expectional and justified. Another example might be assisting a police officer to arrest someone, and then that person then goes on to assault you.
If you were involved in an assault where there has been a history of events or assaults between you and another or others, then this too will probably invalidate a criminal injury compensation claim.
if you had taken illegal drugs and or alcohol and this contibuted to the attack, then again the CICA have to take a view on the circumstances.
This is what the CICA rules say: 'In considering the issue of conduct under paragraph 13(d), a claims officer may withhold or reduce an award where he considers that excessive consumption of alcohol or use of illicit drugs by the applicant contributed to the cirumstances which gave rise to the injury in such a way as to make it inappropriate that a full award, or any award at all be made.' [ paragraph 14, 2001 Scheme ]
In a nut-shell, the scheme is not going to reward individuals who do not abide by the law, like the rest of us. The CICA also have the power to withhold criminal injury compensation if the person who attacked you went on to be convicted.
In other words, just because someone has been found guilty of the assault, then this does not mean that you will automatically receive criminal injury compensation. If your behaviour caused or contributed to the event, then you are unlikely to receive compensation or receive a reduced award.
