Criminal Injury Compensation, why claims fail
The CICA may refuse a criminal injury compensation in certain circumstances due to the behaviour of the claimant. Under paragraphs 13 (d) and 14(2) of the Criminal Injuries Compensation Scheme 2008, the CICA can reduce or refuse a compensation claim if your behaviour significantly contributed to the incident. Similarly, if you had drunk too much alcohol or taken drugs and this too had a material contribution to the incident, then your claim may be reduced or refused.
We recently had a case refused for one of our clients because she had gesticulated in a rude manner to another driver in a road rage incident. The defedant took exception to this and assaulted our client. The CICA refused criminal injury compensation because the rude gesture was the catalyst to the assault.
If you voluntarily involve yourself in a fight and become injured, then it is most unlikely that you will receive criminal injury compensation. This applies even if your opponent then goes on to use a weapon, which you had not bargained for. Also, it is likely that your criminal injury compensation will be reduced or refused if you took part in a revenge attack and became injured or the criminal injury formed part of a history of assault on both sides. For example, you and another had a history of previous bad-blood and violence between each other.
